OnaLaptop.com provides some of our customers with the ability to send and receive electronic mail ("email") associated with their domain name (i.e. you@yourdomain.com). This "personalized email service" is provided on an "as is" and "as available" basis to our customers.

OnaLaptop.com personalized email service is provided to you ("the user") under the terms and conditions contained in this agreement. By using this service you (and your designees) agree to be bound by these terms and conditions.

No conditions, warranties, representations or other terms are made or given by OnaLaptop.com concerning:

• the availability or performance of this email service
• storage of any email messages on your behalf
• security of this email service or personal information of the user
• incoming SPAM, viruses/worms, adult material or offensive email

Any material and/or data downloaded or otherwise obtained through the use of, or from, this service is done at your own risk and you will be solely responsible for any damage to your computer system or loss of data that might occur as a result.

Business use

The OnaLaptop.com personalized email system is provided for legitimate business purposes. Email is a legitimate business communication tool and users are obliged to use this tool in a responsible, effective and lawful manner. Although by its nature email seems to be less formal than other written communication, the same laws apply.

Therefore, the sending (or forwarding) of the following is prohibited:

• Emails for illegal purposes, or in support of illegal activities
• Emails with any libelous, defamatory, offensive, harassing, racist or obscene remarks
• SPAM - Unsolicited email
• Anonymous mailings, or mailings which impersonate another individual, entity or business
• Computer Viruses or Worms
• Copyrighted Material
• Adult Material
• Executables
• Anything that serves to interfere or disrupt the use of email and messaging services by other users.

Privacy

The use of passwords to gain access to the email system or to secure specific files does not provide users with an expectation of email privacy.

You should never send any confidential information via email. Email is not private.

OnaLaptop.com reserves the right to monitor and/or read a user's email at any time. We will maintain the confidentiality of all email (i.e. not divulge the contents of messages) unless we are compelled to disclose such contents for some reason.

Though this is unlikely to happen, there are some very good reasons to do so:

• A court order or law enforcement investigation may require examination and/or release of documents, which may include email
• If necessary to enforce these terms and conditions
• To respond to claims that such contents may violate or infringe on the rights of third parties
• To protect the rights or property of OnaLaptop.com
• To diagnose and correct problems and/or maintain the email system

Once again, OnaLaptop.com reserves the right to monitor and/or read a user's email at any time.

Password Security

When you sign up for this service you are provided (a) password(s). You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify OnaLaptop.com of any unauthorized use of your password or account or any other breach of security.

If you wish to change your password(s), please notify OnaLaptop.com and we may help you to do so at our discretion. All passwords will be known to OnaLaptop.com and may be used, modified or changed by OnaLaptop.com at any time, without regard to the user.

User Conduct

You agree that when using your personalized email account(s) you will:

• Comply with all applicable laws and regulations.
• Be solely responsible for the contents of all messages sent by you or stored in your account(s).

In addition, you agree that you will not engage, in any way, in any of the following prohibited activities:

• Use the email system for any purpose prohibited by laws or regulations.
• Sending copies of any documents, and/or inclusion of works of others in violation of copyright laws.
• Use your personalized email account to harass or intimidate others or to interfere with the ability of others to access any email system or the internet.
• "Snooping" i.e., obtaining or attempting to obtain access to the files or email of others without authorization from the recipient of those files or email transmissions.
• "Spoofing" i.e., constructing an email communication so that it appears to be from someone else.
• Attempting to circumvent security measures or otherwise gain unauthorized access to email or other files.
• Send unsolicited email (SPAM) for any reason.
• Send or exchange pornography or adult material.

Spam

Spam is unsolicited email. Spam is not considered acceptable in any way by OnaLaptop.com. OnaLaptop.com may immediately terminate the account of any user who uses OnaLaptop.com personalized email accounts to send Spam.

Encryption

Users may not encrypt any emails without obtaining written permission from OnaLaptop.com. If approved, the encryption key(s) must be made known to OnaLaptop.com.

Server Space

The POP3 mailboxes provided on our servers are not meant for the long term storage of your mail. We ask that you set your mail client to delete mail from the server after downloading so that your mailbox does not become too large. Email may be deleted from the server at any time, for any reason, without regard to the user.

Termination

OnaLaptop.com may terminate this agreement and your use of this email service at any time, for any reason.

These "Email Terms and Conditions of Use" may change periodically, and will be made available on the website, OnaLaptop.com.

Termination of eMail service may be effected without prior notice, and any and all email files may be deleted by OnaLaptop.com at any time.
